These Terms govern your use of mementomori.digital. By creating a protocol and paying for a subscription, you agree to them. Please read carefully — especially sections 3 and 6.
1. Parties
The service is provided by Sole proprietor (FOP) Oleh Reshtak, Kyiv, Ukraine (the "Operator"). The user is the person who created a protocol ("you"). Contact: reolegsup@gmail.com.
2. What the service does
The service stores encrypted messages you address to up to five recipients of your choice, and delivers them if you are out of touch for a long time under the rules in section 6.
3. The service is not a will
mementomori.digital is a technical message delivery service. It does not replace a legal will, is not an inheritance document and has no legal effect on your property. To dispose of your property in case of death, consult a notary or lawyer.
4. Your obligations
- You are at least 18 years old.
- You provide true and current contacts — yours and your recipients' — and keep them up to date in your account.
- You are responsible for the content of your messages and for having the right to share that information with the recipients.
- You do not use the service for illegal content, malware, threats or harassment.
5. Payment
- The subscription costs $2 per month and renews automatically every month. Payments are processed by Stripe.
- You can cancel at any time in your account. The subscription remains active until the end of the paid period; partial months are not refunded unless required by law.
- We may change the price by emailing you at least 30 days in advance. The new price applies from the next billing period.
6. How check-ins and delivery work
- While your payment goes through, the service considers you in touch and does nothing.
- If your payment stops, we email you on day 3, 7 and 25 with an "I'm here" button.
- If you've added a trusted person, from day 25 we write to them too (on day 25 and 28), and if they don't reply, the Operator calls them. The trusted person never sees your messages and can't trigger delivery on their own; they can confirm you're okay, in which case the protocol is frozen and we additionally ask you to confirm it yourself.
- After payment, the trusted person receives an email with a permanent link to tell us at any time that something has happened to you or that you've passed away. The Operator personally verifies every such report, including by calling you. Only if the Operator confirms the death is the subscription cancelled and the protocol moved to delivery without waiting 30 days. If the report is false, nothing changes.
- Clicking "I'm here" without paying freezes the protocol: nothing is delivered until you renew.
- If you cancel the subscription yourself, the protocol is also frozen at the end of the paid period.
- If no one responds for at least 30 days, the Operator reviews the protocol manually and delivers each recipient their message via a personal link.
- By adding a trusted person, you confirm you have the right to share their contact details with us for this purpose.
- You agree that the absence of your response to check-ins is grounds for delivery. That's why it's important to keep your email current.
7. Limitation of liability
- The service is provided "as is". We make reasonable efforts to keep it running but do not guarantee uninterrupted operation.
- We are not liable if delivery is impossible due to invalid or outdated contacts, or for a delivery that occurred because you did not respond to check-ins.
- We are not liable for losses related to digital assets whose access was or was not passed on.
- To the extent permitted by law, our total liability is limited to the amount you paid in the last 12 months.
- Nothing in these Terms limits rights you have under consumer protection law.
8. Termination
You can delete your protocol at any time in your account — this cancels the subscription and deletes your data. We may suspend or terminate the service if these Terms are breached. Data retention periods are described in the Privacy Policy.
9. Changes to these Terms
We may change these Terms. We'll email you about material changes at least 30 days in advance. If you disagree, you can delete your protocol before the changes take effect.
10. Governing law and disputes
These Terms are governed by the laws of Ukraine. We first try to resolve disputes through negotiation — just write to us. If that fails, the dispute is heard by a court under Ukrainian law; this does not deprive you of the right to go to court where you live if the law of your country grants that right.
11. The Memorial tree service
- On tree.mementomori.digital you order the burial of your ashes together with a tree sapling at a place you choose. The price is $500 once plus a $2 monthly subscription (Dead Man's Switch), paid in a single Stripe payment.
- The Operator performs the service after personally confirming your death (through the trusted person, family and/or documents) and receiving the ashes from the trusted person or family. A trusted person is required for this service.
- If burial or planting is impossible at the chosen spot (private or protected land, legal requirements, soil), the Operator performs the service at the nearest available place where it is permitted and sends your family the exact coordinates. If the chosen species doesn't suit the place, the Operator agrees the closest alternative with your family.
- Cancelling the $2 subscription does not cancel the order: the protocol is frozen, and the trusted person can tell us of your death through their permanent link.
- Refunds: within 14 days of payment — in full, on request. If the Operator cannot perform the service, the $500 is refunded to you or, after your death, to the person your family designates.
- The Operator is not responsible for the tree's survival after planting (weather, third parties, decisions of the landowner).
